This Order may be cited as the New Gaborone Airport (Controlled Area) Order.
2. Declaration of controlled area
The area of land specified in the Schedule is hereby declared to be subject to control for the purposes of the Act.
3. Extinguishment of private rights of way
Every private right of way over or entry to the area of land specified in the Schedule or any part thereof is hereby extinguished.
4. Prohibition of entry to and remaining in controlled area
(1) No person shall enter or, having entered, remain in the area of land specified in the Schedule or any part thereof unless he has a lawful right to do so.
(2) Any person who contravenes this paragraph shall be guilty of an offence and liable to a fine not exceeding P500 or to imprisonment for a term not exceeding six months, or to both.
(3) In any proceedings for an offence under this paragraph or for attempting or conspiring with another person to commit such an offence, the court shall presume that no person accused in the proceedings had, at any time, a lawful right to enter or remain in the area of land specified in the Schedule or any part thereof unless the contrary is proved.
SCHEDULE
The security fenced area immediately west of the farm Content No. 1-KO measuring approximately 1 125 hectares in extent, the boundaries of which are shown on Plans KO-278 and KO-279, deposited with the Director of Surveys and Lands, Gaborone.
