An Act to impose an export duty in respect of bonemeal, bloodmeal and carcassmeal and to provide for matters incidental thereto.

[Date of Commencement: 1st January, 1962]

1.    Short title

    This Act may be cited as the Bonemeal, Bloodmeal and Carcassmeal (Export Duty) Act.

2.    Interpretation

    In this Act, unless the context otherwise requires—

    “authorised officer” means a District Commissioner and any other officer of the public service of Botswana authorised in writing by a District Commissioner to be an authorised officer for the purposes of this Act.

3.    Imposition of duty

    Subject to section 6, export duty shall be payable on all bonemeal, bloodmeal and carcassmeal exported from Botswana at the rates set out in the Schedule.

4.    No export of bonemeal, bloodmeal and carcassmeal until duty paid

    (1) No person shall export any bonemeal, bloodmeal or carcassmeal from Botswana unless he has paid any export duty payable in respect thereof to an authorised officer and is in possession of a receipt in respect of such duty issued to him by that authorised officer.

    (2) Any person who contravenes the provisions of this section shall be guilty of an offence and liable to a fine not exceeding P200 or to imprisonment for a term not exceeding six months, or to both.

5.    Export to be by rail

    (1) Subject to section 6, no person shall export bonemeal, bloodmeal or carcassmeal from Botswana otherwise than by rail except with the written permission of an authorised officer.

    (2) Any person who contravenes the provisions of this section shall be guilty of an offence and liable to a fine not exceeding P200 or to imprisonment for a term not exceeding six months, or to both.

6.    Samples and temporary exports

    Nothing in sections 3 and 5 shall apply in respect of any consignment of bonemeal, bloodmeal or carcassmeal—

    (a)    which does not exceed 2.5 kilograms in weight and is exported from Botswana as a bona fide sample; or

    (b)    which is temporarily exported from Botswana in transit to some place within Botswana.

7.    Saving of Government’s civil remedies

    No criminal proceedings or conviction under this Act shall affect any civil remedy to which the Government is entitled for the recovery of the export duty payable by any person.

8.    Power of Minister to amend Schedule

    The Minister may, after consultation with the Minister for the time being responsible for finance, by statutory instrument, amend the rate of duty prescribed in the Schedule.
