1.    Citation

    These Regulations may be cited as the Control of Livestock Regulations.

2.    Interpretation

    In these Regulations—

    “district” means an administrative district prescribed under section 2 of the Administrative Districts Act (Cap. 03:02);

    “licence” means a licence under Part II of the Act.

3.    Permits restricted to area of issue

    Every licence shall be issued subject to the condition that the licence shall be valid within the district in which it is issued only unless the officer authorised to issue licences in some other district endorses the licence for use in such other district.

4.    No person to have more than one licence

    Not more than one licence shall be issued to any person in respect of any district and no person shall acquire more than one licence authorising the buying of livestock within any district.

1.    Citation

    These Regulations may be cited as the Livestock Sales (Permits) Regulations.

2.    Interpretation

    In these Regulations, unless the context otherwise requires—

    “permit” means a Chief’s permit and a District Commissioner’s permit issued under the provisions of section 3 of the Act;

    “purchase” includes “acquire”;

    “sale” includes disposal of.

3.    Form of permit

    Every permit shall be in the Form set out in the First Schedule.

4.    Fees payable

    Upon the issue of a permit there shall be payable in respect of each head of livestock whose sale such permit authorises the fees set out in the Second Schedule.

5.    Copy of permit to revenue officer

    A copy of each permit issued shall be sent by the issuer to the revenue officer of the District Council within whose area of jurisdiction the permit has been issued.

6.    Time when payment is due

    Notwithstanding anything contained in regulation 4 no fee shall become due unless the livestock in respect of which it is payable is sold.

7.    Endorsement of permit

    Any person purchasing livestock whose sale is authorised by a permit shall at the time of purchase endorse on such permit the type and number of livestock he has purchased, his name and address, the date of purchase and the fees payable by him and shall within seven days of such purchase send to the revenue officer of the District Council within whose area of jurisdiction the permit was issued a return in the Form set out in the Third Schedule together with the fees due in respect of the livestock he has purchased.

8.    Minister’s power to exempt

    The Minister may, on application, exempt any person from the provisions of regulation 7 and issue directions as to the time and manner in which such person may submit the returns referred to in regulation 7:

    Provided that any such exemption shall not relate to the fees payable under these Regulations.

9.    Liability for fee

    Notwithstanding that the duty to pay the fees is imposed upon the purchaser of the livestock, fees shall be due from the holder of the permit and the purchaser may deduct from the purchase price payable to the holder of the permit the fees due to the authority who issued the permit.

10.    Penalty

    (1) Any purchaser who fails to endorse a permit as required by regulation 7 or who fails to send a return together with the appropriate fee as required by that regulation shall be guilty of an offence and liable to a fine not exceeding P100 or to imprisonment for a term not exceeding one month, or to both:

    Provided that a conviction under this subregulation shall in no way relieve a purchaser of his liability to pay the fees due to the appropriate authority.

    (2) Any person who with an intention to deceive makes a false entry on a permit or a return shall be guilty of an offence and liable to imprisonment for a term not exceeding three months.

LIVESTOCK SALES (PERMITS) (BUCA) REGULATIONS

1.    Citation

    These Regulations may be cited as the Livestock Sales (Permits) (BUCA) Regulations.

2.    Interpretation

    In these Regulations, unless the context otherwise requires—

    “permit” means a Chief’s permit or a District Commissioner’s permit issued under section 3 of the Act;

    “Permit Regulations” means the Livestock Sales (Permits) Regulations.

3.    No fee payable in certain circumstances

    Notwithstanding the provisions of the Permit Regulations, no fee shall be payable in respect of permits where the livestock, the subject matter of the permit, are sold and the entire proceeds of sale are donated to the Botswana University Campus Appeal, also known as “BUCA”.

4.    Permits to be endorsed

    For the avoidance of doubt it is expressly declared that, notwithstanding the provisions of regulation 3, nothing in these Regulations shall affect any other obligation imposed on any person by the Permit Regulations.
