1.    Citation

    These Regulations may be cited as the Control of Goods (Beef Prices) Regulations.

2.    Maximum prices for selected fresh beef products

    The retail price at which each of the following fresh beef products may be sold in Francistown, Gaborone, Kanye, Lobatse, Mahalapye, Mochudi, Mogoditshane, Molepolole, Palapye, Pilane, Ramotswa, Selebi-Phikwe, Serowe, Shashe, Tlokweng and Tonota shall not exceed the price specified opposite thereto?

1.    Citation

    These Regulations may be cited as the Control of Goods (Import and Export of Agricultural Products) Regulations.

2.    Interpretation

    For the purposes of these Regulations “authorised officer” means the officer in the Ministry of Agriculture who is charged with the responsibility of issuing permits for the importation into Botswana and exportation out of Botswana of agricultural products.

3.    Restriction on importation of certain agricultural products

    (1) No person shall import any agricultural products specified in the First Schedule hereto except under and in accordance with a written permit issued by the authorised officer.

    (2) Notwithstanding the provisions of subregulation (1), no permit shall be required for the importation of?

    (a)    …

    (b)    seed intended for planting, being a consignment or part of a consignment clearly marked as seed; or

    (c)    any agricultural product specified in the Second Schedule hereto,

where such goods are imported by any person for the purpose of that person’s own consumption or use and in the quantities specified in the said Schedule.

4.    Restriction on exportation of certain agricultural products

    (1) No person shall export any agricultural product specified in the Second and Third Schedules hereto except under and in accordance with a written permit issued by the authorised officer.

    (2) Notwithstanding the provisions of subregulation (1), no permit shall be required for the exportation of any agricultural product which does not exceed the quantities specified under the Second Schedule.

5.    Application for permit

    (1) An application for an import or export permit, as the case may be under these Regulations, shall be made to the authorised officer, and such application shall contain such information and shall be accompanied by such documents as may be specified by the authorised officer.

    (2) Any person applying for an import permit under these Regulations shall produce, to the authorised officer, such information or documents as the officer may require, proving that at least?

    (a)    30% of the maize grain;

    (b)    70% of the maize meal, samp, maize rice or animal feed for poultry and livestock;

    (c)    50% of the sorghum grains; or

    (d)    70% of the sorghum meal, sorghum rice or any other processed sorghum product,

which is the subject of his or her application, was obtained in Botswana.

    (3) An application for an import and export permit under subregulation (1) shall be accompanied by an application fee of P150.

6.    Issue of permit

    Where the authorised officer is satisfied that an applicant for a permit is a fit and proper person and such person has complied with all the conditions specified for the issue of a permit, he may issue the applicant with an import or export permit, as the case may be.

7.    Appeal

    Any person who is aggrieved by the refusal of the authorised officer to issue him with an import or export permit, as the case may be, under these Regulations may appeal to the Minister of Agriculture whose decision thereon shall be final.

1.    Citation

    These Regulations may be cited as the Control of Goods (Import Control) Regulations.

2.    Interpretation

    In these Regulations, unless the context otherwise requires?

    bona fide gift” means an unsolicited gift for which no charge has been or is to be made, sent to the addressee and certified by the addressee to be a bona fide gift;

    “common customs area” means the combined areas of Botswana, Lesotho, Republic of South Africa and Swaziland;

    “Controller” means the person designated Controller of Imports under regulation 3;

    “free-trade area” means the countries of Zimbabwe and Malawi;

    “import permit” or “permit” means a permit issued by the Controller under regulation 7;

    “personal effects” means household and personal goods, whether new or otherwise, imported for personal use and not for trade;

    “trade” means to carry on the business of buying or selling of goods by retail or wholesale and includes barter or exchange;

    “trade sample” means goods imported without any charge, for publicity and information and not for trade.

3.    Controller of Imports

    (1) The Minister shall by notice published in the Gazette designate a public officer to be the Controller of Imports.

    (2) The Controller may delegate any of his duties or functions under this Act to any public officer.

4.    Restriction on importation of certain goods

    Subject to the provisions of regulation 10, no person shall import into Botswana any goods specified in Schedule 1 to these Regulations except under and in accordance with an import permit issued under these Regulations.

5.    Application for import permit

    (1) An application for an import permit shall be made to the Controller in the form 1″/> as may be specified by the Controller.

    (2) Every application shall be accompanied by such documents or information as the Controller may consider necessary to specify.

6.    Person entitled to apply for permit

    A person shall not be entitled to apply for an import permit under these Regulations unless he is a holder of a valid trading licence and?

    (a)    he is a citizen of Botswana and is not a minor;

    (b)    he holds a resident permit authorising him to carry on business in Botswana; or

    (c)    it is a company or firm registered and carrying on business in Botswana.

7.    Issue of import permit

    On receipt of an application made under regulation 5, the Controller shall, upon payment of such fee as he may specify by notice published in the Gazette issue, subject to such conditions as he may impose or as may be attached thereto, an import permit to the applicant.

8.    Duration and renewal of import permit

    (1) Unless cancelled or revoked, an import permit issued under regulation 7 shall be valid for a period of six months beginning from the date of issue of the permit and may be renewed from time to time.

    (2) When renewing an import permit, the Controller may vary the conditions attached to the permit and may impose additional conditions.

9.    Import permit not transferable, negotiable, etc.

    An import permit issued under these Regulations shall not be transferred, negotiated, sold or used to the benefit of any person not named in the permit without the prior written approval of the Minister.

10.    Exemptions

    Notwithstanding the provisions of regulation 4, an import permit shall not be required for the importation of goods prescribed thereunder where such goods are being imported for the following purposes?

    (a)    as bona fide gifts;

    (b)    as personal effects; or

    (c)    as trade samples:

    Provided that the total value or quantity of such imports in a single consignment does not exceed the value or quantity prescribed by the Controller in a notice published in the Gazette for such purposes.

11.    Appeal

    An applicant who is aggrieved by a decision of the Controller?

    (a)    as to any condition attached to his import permit; or

    (b)    to cancel, withdraw or suspend his import permit,

may appeal to the Minister within 30 days from the date of such decision of the Controller.

12.    Offences and penalties

    (1) Any person who contravenes or fails to comply with the provisions of these Regulations shall be guilty of an offence.

    (2) Any person who is convicted of an offence under these Regulations shall be liable?

    (a)    for a first offence, to a fine not exceeding P200 or to imprisonment for a term not exceeding six months, or to both; and

    (b)    for a second or subsequent offence, to a fine not exceeding P400 or to imprisonment for a term not exceeding 12 months, or to both.

INSTRUCTIONS TO IMPORTERS

1.    Applications for permits to import goods into the Republic of Botswana must be submitted in original only on this form. Applicants may have their own forms printed provided the particulars and layout conform with the official form.

2.    A permanent reference number will be allocated to each importer at the time his first application is received. This number must be quoted to all subsequent applications and relative correspondence.

3.    Importers may enclose, with their applications, unstamped addressed envelopes to be used for forwarding permits to them.

4.    A separate application form must be submitted in respect of each country of supply and each individual supplier.

5.    Goods must be grouped in classes, and each class must be grouped separately on the application form. When the number of items warrants it, a separate form may be used for each class of goods. One item only should be entered on one ruled line.

6.    The purpose for which goods are required must be stated clearly and adequately. When goods are required for, or to replace stocks sold to Government Departments, or for the provision or maintenance of public services, or for use by any specified industry, this fact must be stated and documentary evidence from the department or industry concerned, may be required at the discretion of the Controller of Imports.

7.    If and when goods are required to replace a consignment lost in transit, particulars sufficient to identify it, including numbers of covering permits, should be furnished with the application.

8.    The issue of an Import Permit will convey no guarantee of supply or shipment.

9.    The issue of a permit may be refused, or quantities applied for curtailed, without assignment of any reason.

10.    Telegraphic, telephonic or personal applications will not be entertained.

11.    If an applicant for a permit supplies any false information in connection with his application, the Controller will refuse such application.

12.    Applications for import permits in respect of goods the importation of which is restricted under any other law of Botswana (e.g. arms, ammunition, livestock, agricultural products, etc.) must be accompanied by a valid permit issued under the law concerned.

13. The signatory to an application for import permit MUST be either-

    (a)    the actual importer for a personal importation;

    (b)    the proprietor or owner in the case of importation by private trader; or

    (c)    the Director, Secretary or authorised agent in the case of importation by a limited company.

1.    Citation

    These Regulations may be cited as the Control of Goods (Importation of Sugar) Regulations.

2.    B.D.C. to be sole importer of sugar

    (1) The Botswana Development Corporation (in these Regulations referred to as the “Corporation”) shall be the sole importer of sugar for a period of 10 years beginning from the date of commencement of these Regulations:

    Provided that any person may import up to 12,5 kg of sugar for his personal consumption.

    (2) The Corporation shall make such arrangements as it considers necessary for the importation of sugar.

3.    Penalties

    Any person, other than the Corporation, who imports sugar shall be guilty of an offence and shall be liable to the penalties specified in section 5 of the Act.

1.    Citation

    These Regulations may be cited as the Control of Goods (Authorised Officers) Regulations.

2.    Interpretation

    In these Regulations, unless the context otherwise requires, “authorised officer” means a person appointed by the Minister as such under regulation 3.

3.    Power to appoint authorised officers

    For the purpose of securing compliance with regulations made under the Act, the Minister may appoint such persons as may appear to him necessary or expedient for such purpose to be authorised officers.

4.    Powers of authorised officers

    Authorised officers shall have the power to?

    (a)    enter into and inspect premises to which regulations made under the Act apply; and

    (b)    require persons carrying on or employed in connection with any trade, business, undertaking or enterprise to produce books, accounts or other documents relating to that trade, business, undertaking or enterprise.

5.    Offence

    Anybody who obstructs an authorised officer in the exercise of the powers conferred by regulation 4 shall be guilty of an offence.

1.    Citation

    These Regulations may be cited as the Control of Goods (Marking of Goods) Regulations.

2.    Interpretation

    In these Regulations, unless the context otherwise requires?

    “offer for sale” includes invitation to treat;

    “premises” includes any display-window, shop-window or show case;

    “prescribed details” means the details required by regulation 3 to be displayed in respect of any goods.

3.    Marking of goods

    (1) No person shall offer for sale by retail on any premises any goods unless such goods have clearly marked thereon or in a position to be clearly visible to prospective purchasers?

    (a)    the cash price of such goods; and

    (b)    the quantity of goods to which such price relates,

in the manner prescribed by these Regulations.

    (2) In the prescribed details the abbreviations specified in the second column of the Schedule may be used in place of the words respectively specified in the first column of the said Schedule.

4.    Goods sold pre-packed or individually

    Where goods are offered for sale pre-packed or as individual items, each such pre-packed article or individual item shall be marked with the prescribed details in characters not less than 5 mm in height and, except in the case of the figure “1”, 2 mm wide:

    Provided that where goods are of such a nature that, for reasons of?

    (i)    weight;

    (ii)    size or bulk;

    (iii)    hygiene; or

    (iv)    security,

they cannot be so marked or cannot be handled by a prospective customer, the prescribed details may be displayed in such a way as to be clearly identifiable with such goods and in characters of not less than 10 mm in height and, except in the case of the figure “1”, 4 mm wide.

5.    Goods sold in bulk

    Where goods are offered for sale from bulk and in accordance with a purchaser’s requirements as to weight, measure or number, the prescribed details shall be displayed in such manner as to be clearly identifiable with such goods and in characters of not less than 10 mm in height and, except in the case of the figure “1”, 4 mm wide.

6.    Goods sold on hire-purchase

    Where goods are offered for sale on hire-purchase terms or by way of credit-sale or on any other terms as to deferred payment the following details shall be displayed in addition to the prescribed details and in characters of similar size?

    (a)    the amount of any deposit;

    (b)    the amount of each instalment;

    (c)    the frequency of instalments;

    (d)    the total number of instalments; and

    (e)    the total amount to be paid by way of deposit and instalments.

7.    Discounts

    Where goods are offered for sale at a discount whether for prompt payment, bulk purchase, for a limited time or for any other reason, details of the amount to be purchased or the date of termination of such limited time, as the case may be, shall be displayed with the prescribed details and in characters of similar size.

8.    Goods to be sold at a lower price

    Where goods are offered for sale at a price lower than that previously displayed, the prescribed details of such former price shall be cancelled or obliterated and shall not be restored, and the prescribed details of such lower price shall be displayed.

9.    Prescribed details not to be altered

    Except in the case of a genuine mistake or with the approval of an authorised officer appointed under the Control of Goods (Authorised Officers) Regulations, no person shall alter any of the prescribed details in respect of any goods when such goods have been displayed if the result of such alteration would be either?

    (a)    to increase the price of such goods; or

    (b)    to reduce the quantity to which the price relates.

10.    Prescribed details not to be removed

    Except at the request of a purchaser and only after sale has been concluded, no person shall remove the prescribed details from any goods.

11.    Markings to be in ink, etc.

    The prescribed details shall be marked in non-toxic ink, paint or other indelible substance and, subject, to the proviso to regulation 4 and, to regulation 5, only be printed?

    (a)    on the goods themselves;

    (b)    on a label securely affixed thereto; or

    (c)    on any container, package or wrapping material in which the goods are contained, packed or wrapped and offered for sale.

12.    Offences

    Any person who contravenes any of the provisions of these Regulations shall be guilty of an offence.

1.    Citation

    These Regulations may be cited as the Control of Goods (Trading Margins) Regulations.

2.    Interpretation

    In these Regulations, unless the context otherwise requires?

    “authorised officer” means an authorised officer appointed under the Control of Goods (Authorised Officers) Regulations, and includes the Price Controller and a Price Control Inspector;

    “cost price” of any goods in respect of a trader, means the price paid or to be paid by him for those goods excluding any discounts not exceeding 10 per cent in toto allowable for prompt payment, bulk order or otherwise, and excluding insurance, freight and delivery charges; and where the price is stated in foreign currency the price in pula shall be ascertained by reference to the rate of exchange on the day on which the goods were imported into Botswana;

    “distributor” means a wholesaler who sells to wholesalers;

    “manufacturer” means a person who manufactures, or by any process produces, an article from raw, unfinished or partly manufactured materials for sale to a distributor, wholesaler, retailer or direct to the public;

    “mark-up”, in respect of any goods, means the difference between the actual price at which such goods are sold by a trader, exclusive of any insurance, freight or delivery costs, and the cost price to the trader of such goods plus any insurance, freight, delivery, processing or packaging costs calculated as a percentage of such cost price;

    “Price Controller” means the person designated as such under regulation 3;

    “Price Control Inspector” means a person designated as such under regulation 3;

    “price list” means a price list required to be delivered to the Price Controller under regulation 5;

    “retailer” means?

    (a)    a person who holds or is required to hold a licence under the Trade Act (Cap. 43:02), other than an agent, an auctioneer, a driller, an external representative, an insurance agent, a produce buyer or a wholesaler licence;

    (b)    a person who holds or is required to hold a bottle store liquor licence under the provisions of the Liquor Act (Cap. 43:11);

    (c)    a person who, being the holder of, or being required to hold, an hotel liquor licence under the provisions of the Liquor Act, sells liquor in an off-sales department as defined in that Act;

    “sale” includes offer for sale and invitation to treat;

    “sales agent” means a person who holds or is required to hold an agent’s licence or an external representative’s licence issued under the Trade Act or the Liquor Act;

    “trader” includes wholesaler, distributor, sales agent and retailer;

    “wholesaler” means a person who holds or is required to hold a wholesaler’s licence issued under the Trade Act or the Liquor Act.

3.    Appointment of Price Controller and Inspectors

    (1) The Minister may, by notice published in the Gazette, designate a public officer to be Price Controller, and such other persons as he deems fit to be Price Control Inspectors.

    (2) The Price Controller and all Price Control Inspectors shall be deemed to be authorised officers for the purposes of the Control of Goods (Authorised Officers) Regulations.

4.    Application

    (1) Subject to the provisions of subregulation (2), these Regulations shall apply to the sale of all goods other than those in respect of which separate price restrictions have been imposed under the Act.

    (2) These Regulations shall not apply to the sale of any goods for delivery outside Botswana.

5.    Delivery of price lists

    (1) No manufacturer, distributor, sales agent or wholesaler shall sell any goods unless he has delivered to the Price Controller two copies of his price list in respect of those goods.

    (2) If the Price Controller is not satisfied with a price list he may?

    (a)    call for such further information as he may think necessary; or

    (b)    declare that such goods shall not be sold in Botswana.

    (3) A price list shall include the following information?

    (a)    the price actually paid or to be paid by him for such goods;

    (b)    the cost of transport or delivery, if additional to the price paid;

    (c)    any costs incurred in processing or packaging;

    (d)    the price at which such goods are to be sold;

    (e)    details of any discounts allowable to a purchaser whether for prompt payment, bulk orders or otherwise;

    (f)    details of any transport or delivery charges if payable by a purchaser.

    (4) Any manufacturer, distributor, sales agent or wholesaler who?

    (a)    gives any false information in a price list;

    (b)    sells any goods at a price exceeding the sale price quoted in a price list; or

    (c)    sells any goods without having first delivered a price list in respect of such goods to the Price Controller,

shall be guilty of an offence.

    (5) The Minister may exempt any class of manufacturers, distributors, sales agents or wholesalers in respect of any specific goods or class of goods from the provisions of subregulation (1).

6.    Delivery of invoice or cash sale slip by manufacturer, etc.

    (1) No manufacturer, distributor, sales agent or wholesaler shall sell any goods unless at the time of sale he delivers to the purchaser, in the case of a credit sale, an invoice, or, in the case of a cash sale, a cash sale slip which shall, in either case, include the following information?

    (a)    a description of the goods sold;

    (b)    the date of sale;

    (c)    the name of the purchaser;

    (d)    the unit price of the goods sold;

    (e)    the quantity of goods sold; and

    (f)    the total price of the goods sold.

    (2) A copy of every invoice or cash-sale slip issued under subregulation (1) shall be retained by the person issuing it for two months from the date of issue and shall be kept available for inspection by an authorised officer.

    (3) The original of every invoice or cash-sale slip issued under subregulation (1) shall be retained by the purchaser to whom it is issued for a period of two months from the date of issue and shall be kept available for inspection by an authorised officer.

    (4) Any person who contravenes the provisions of this regulation shall be guilty of an offence.

7.    Delivery of invoice or cash sale slip by retailer

    (1) No retailer shall sell any goods unless, at the time of sale, if so required by a purchaser, he delivers to the purchaser, in the case of a credit sale, an invoice giving the following information, namely?

    (a)    the name of the purchaser;

    (b)    a description of the goods sold;

    (c)    the date of sale;

    (d)    the unit price of the goods sold;

    (e)    the quantity of goods sold; and

    (f)    the total price of the goods sold,

or, in the case of a cash sale, a dated cash sale slip:

    Provided that, in the case of a cash sale, no cash sale slip need be issued in respect of goods sold with the unit-price thereof marked upon the goods themselves or upon any package in which the goods are wrapped or packed separate from other goods.

    (2) A copy of every invoice or cash sale slip issued under subregulation (1) shall be retained by the person issuing it for a period of two months from the date of issue and shall be kept available for inspection by an authorised officer.

    (3) Any person who contravenes the provisions of this regulation shall be guilty of an offence.

8.    Goods imported for sale

    (1) No retailer importing goods for sale shall sell any such goods unless he has delivered to the Price Controller a statement of the actual cost to him of such goods, setting out as separate items, transport, insurance and other charges included in such cost.

    (2) If the Price Controller is not satisfied with a statement delivered to him pursuant to subregulation (1) he may?

    (a)    call for such further information as he may think necessary; or

    (b)    declare that such goods shall not be sold in Botswana.

    (3) Any retailer who?

    (a)    gives false information in a statement delivered pursuant to subregulation (1);

    (b)    fails to give any information called for by the Price Controller under subregulation (2)(a);

    (c)    sells any goods without having first delivered to the Price Controller the statement required under subregulation (1); or

    (d)    sells goods in contravention of subregulation (2)(b),

shall be guilty of an offence.

9.    Mark-ups

    (1) No distributor, sales agent or wholesaler shall sell any goods specified in the first column of the Schedule with a mark-up greater than that respectively specified in relation thereto in the second column of the said Schedule.

    (2) No retailer shall sell any goods specified in the first column of the Schedule with a mark-up greater than that respectively specified in relation thereto in the third column of the said Schedule.

    (3) Where the Price Controller is satisfied that a manufacturer, distributor, sales agent, wholesaler or retailer has a common interest with another distributor, sales agent, wholesaler or retailer, he may, by notice served on the persons concerned, limit the total aggregate mark-up on goods passing between those persons.

    (4) For the purposes of subregulation (3), a common interest shall be deemed to exist when?

    (a)    a manufacturer, distributor, sales agent, wholesaler or retailer owns or controls in any distributor, sales agent, wholesaler or retailer, 20 per cent or more of any class of voting shares or other voting participation, either directly or indirectly, or such shares are held with power to vote, or has the power to elect a majority of directors in such other distributor, sales agent, wholesaler or retailer;

    (b)    one person owns or controls in any manufacturer, distributor, sales agent, wholesaler or retailer 20 per cent or more of any class of voting shares or other voting participation, either directly or indirectly, or holds such shares with power to vote, or has the power to elect a majority of directors, and he or a member of his immediate family owns or controls a similar holding or has similar power in or over any other manufacturer, distributor, sales agent, wholesaler or retailer.

    (5) For the purposes of subregulation (4), immediate family includes parent, spouse, child, brother or sister.

    (6) Any distributor, sales agent, wholesaler or retailer who sells any goods with a mark-up greater than that permitted by or under this regulation shall be guilty of an offence.

10.    Appeal to Minister

    Any person dissatisfied with any declaration by the Price Controller under regulation 5(2) or 8(2)(b), or any notice served by the Price Controller under regulation 9(3), may appeal to the Minister.

1.    Citation

    These Regulations may be cited as the Control of Goods (Importation of Eggs and Poultry Meat) Regulations.

2.    Interpretation

    In these Regulations?

    “eggs” means the eggs of any domestic fowl;

    “the Government poultry office” means the principal office in Gaborone of the department of the Government for the time being concerned with the regulation of the production of eggs and poultry meat;

    “import permit” means a permit such as is referred to in regulation 3;

    “officer” has the same meaning as in the Customs and Excise Duty Act (Cap. 50:01);

    “place of entry” means a place of entry for the purposes of the Customs and Excise Duty Act;

    “poultry meat” means the meat, including the blood, bones, fat and flesh, of any domestic fowl, whether fresh or dried, frozen, tinned or otherwise preserved.

3.    Restriction on importation of eggs and poultry meat

    No person shall import eggs or poultry meat except under and in accordance with a written permit issued under these Regulations by the Minister for the time being responsible for agriculture or by a person authorised by him in that behalf:

    Provided that a person may, without a permit issued under these Regulations, import for consumption by himself or his immediate family not more than 36 eggs and 5 kg of poultry meat at any one time.

4.    Application for import permit

    Any person wishing to obtain an import permit shall lodge an application, in such form as the Minister for the time being responsible for agriculture may require, at the Government poultry office.

5.    Import permit to be presented at place of entry

    The importer of eggs or poultry meat under an import permit shall present the import permit or cause it to be presented for verification to an officer at the place of entry of the eggs or poultry meat.

6.    Validity of import permit

    (1) An import permit shall be valid in respect of one consignment alone whether of eggs or poultry meat or of both eggs and poultry meat.

    (2) An import permit shall, in any event, cease to be valid at the expiry of 30 days immediately after the date of issue stamped thereon.

7.    Return of import permit to Government poultry office

    Every holder of an import permit shall surrender the permit at or transmit it by post to the Government poultry office not later than seven days immediately after the day on which the eggs or poultry meat to which the permit relates were imported or on which the permit ceased to be valid by virtue of regulation 6(2), whichever is the earlier.

8.    No fees payable in respect of import permit

    No fee shall be payable in respect of an application for or the issue of an import permit.

9.    Power to suspend Regulations

    The Minister may, by order published in the Gazette, suspend the operation of these Regulations either indefinitely or for such period as he may specify in the order and subject to such conditions as he may specify in the order.

CONTROL OF GOODS (IMPORTS FROM AND EXPORTS TO IRAQ OR OCCUPIED KUWAIT) REGULATIONS

2.    Prohibition of imports and exports

    No person shall import any goods from, or export any goods to, Iraq or occupied Kuwait:

    Provided that the provisions of this regulation shall not apply to any goods exported to Iraq or occupied Kuwait for humanitarian purposes in accordance with any resolution of the United Nations.

3.    Forfeiture

    Any goods being imported into Botswana or exported from Botswana in contravention of regulation 2 may be seized and shall be forfeited to the Government.

    These Regulations may be cited as the Control of Goods, Prices and Other Charges (Returnable Containers) Regulations.

2.    Interpretation

    In these Regulations, unless the context otherwise requires?

    “returnable container” means such container, including a crate and a barrel, marked as specified in the Schedule hereto, in which the bottler thereof retains ownership.

3.    Marking of containers

    The manufacturer of a returnable container shall ensure that it is clearly marked “returnable for deposit”.

4.    Deposits and refunds on containers

    A person who sells any soft drink, beer or other product in a returnable container shall?

    (a)    charge as a deposit, in relation to the size of the returnable container in which it is contained, such amount as may be specified in the second column of the Schedule; and

    (b)    refund that deposit to any person who returns to him an empty, unbroken or undamaged returnable container in the form the buyer wants, whether upon an exchange of goods, credit or cash.

5.    Offences and penalties

    Any person who contravenes or fails to comply with the provisions of these Regulations shall be guilty of an offence and be liable?

    (a)    for a first offence, to a fine not exceeding P200 or to imprisonment for a term not exceeding six months, or to both; and

    (b)    for a second or subsequent offence, to a fine not exceeding P400 or to imprisonment for a term not exceeding one year, or to both.

1.    Citation

2.    Interpretation

    In these Regulations, unless the context otherwise requires, “liquefied petroleum gas cylinder” means a vessel approved for storage and carriage of liquefied petroleum gas and is of any of the following capacities:

            9; 14; 19 and 48 kilograms.

3.    Restriction on import and export of cylinders

    No person shall import or export liquefied petroleum gas cylinders bearing the brand or trade name of a company without the written permission of the company.

1.    Citation

2.    Levy on intoxicating liquor

A person who?

    (a)    produces intoxicating liquor specified in the Schedule shall pay a levy of 35 per cent of value of such goods when sold for home consumption; and

    (b)    imports intoxicating liquor specified in the Schedule shall pay a levy at a rate of 35 per cent of the value of such goods.

3.    Calculation of value of levy

    The value for purposes of assessing the levy on intoxicating liquor?

    (a)    locally produced, shall be the cost of production of the intoxicating liquor when sold for home consumption in the ordinary course of trade in the usual trade packaging to any buyer not deemed to be related to the seller inclusive of any duty payable on the goods in terms of the Customs Act (Act No. 33 of 2018) and Excise Duty Act (Act No. 34 of 2018) and exclusive of value added tax liable on the goods; and

    (b)    imported, shall be the value for customs duty purposes in terms of section 326 of the Customs Act, inclusive of any duty payable on the goods in terms of the Customs Act and Excise Duty Act plus transport and insurance costs of the goods and exclusive of value added tax liable on the goods.

4.    Fund into which levy payable

    The levy under regulation 2 shall be collected by the Botswana Unified Revenue Service and credited to the Levy on Alcoholic Beverages Fund and the manner of utilising the levy shall be as specified in the Order establishing the Levy on Alcoholic Beverages Fund.

5.    Application of Regulations

    These Regulations shall not apply to?

    (a)    intoxicating liquor when exported directly by the producer or from a bonded warehouse;

    (b)    intoxicating liquor when imported as passengers’ baggage in the quantities prescribed under Rebate Item 407:02 of the Customs and Excise Duty Regulations (Cap. 50:01 (Sub. Leg.)) or Schedule No. 2 of the Value Added Tax Act (Cap. 50:03).

    (c)    undenatured ethyl alcohol strength by volume of 80 per cent volume or higher; ethyl alcohol and other spirits, denatured, of any strength, used as raw materials for industrial purposes.

1.    Citation

    These Regulations may be cited as the Control of Goods, Prices and Other Charges (Marking and Labelling of Halaal and Non-halaal Meat and Meat Products) Regulations.

2.    Interpretation

    In these Regulations, unless the context otherwise requires?

    “halaal” means meat or a meat product prepared under and maintained in strict compliance with the laws and customs of the Islamic religion;

    “meat” includes beef, mutton, poultry, goat, pork, fish or lamb;

    “meat product” means any article of food intended for sale for human consumption and derived or prepared in whole or in part from the carcass or the organs or viscera of cattle, sheep, poultry, goat, pig, fish or lamb;

    “non-halaal” means any meat or meat product not prepared under or maintained in strict compliance with the laws and customs of the Islamic religion; and

    “supermarket/chain store” means a self service store of at least 1000 square metres, that sells a wide range of food items, household goods and wines but not beers and spirits.

3.    Marking and labelling of halaal and non-halaal meat

    (1) Where halaal and non-halaal meat or meat product is offered for sale in any supermarket or chain store, the seller shall?

    (a)     mark or label the meat or meat product with the words “halaal” or “non-halaal” in such a way that it is clearly identifiable and in characters of not less than 10mm in height;

    (b)     display over the halaal meat or meat products signs that read, in clearly visible block letters, “halaal meat and meat products”;

    (c)     display over the non-halaal meat or meat products signs that read, in clearly visible block letters, “non-halaal meat and meat products”; and

    (d)     separate the halaal meat or meat products from the non-halaal meat or meat products to avoid any contamination.

    (2) Any person who contravenes this regulation commits an offence and is liable?

    (a)     for a first offence, to a fine not exceeding P1 000 or to imprisonment for a term not exceeding six months, or to both; and

    (b)     for a second or subsequent offence, to a fine not exceeding P2 000 or to imprisonment for a term not exceeding one year, or to both.

4.    Selling halaal or non-halaal under false pretences

    Any person who offers for sale in a supermarket or chain store?

    (a)     halaal meat or meat product as non-halaal; or

    (b)     non-halaal meat or meat product as halaal, commits an offence and is liable?

    “Department” means the Department of Energy within the Ministry of Minerals, Energy and Water Resources; and

    “National Electrification Fund” means the Fund established under the National Electrification Fund Order (Cap. 54:01 (Sub. Leg.)).

3.    Levy on electricity consumption

    (1) Botswana Power Corporation shall pay a levy at a rate of 10 thebe per kilo-watt-hour of electricity sold.

    (2) The levy payable by the Botswana Power Corporation in subregulation (1) shall be charged to the end users of electricity.

4.    Calculation of value of levy

    The value for the purpose of assessing the levy on electricity consumption shall be the kilo-watt-hours sold multiplied by the value of the levy.

5.    Fund into which levy is payable

    (1) The levy under regulation 3 shall be collected by the Botswana Power Corporation and transferred to the Department and the levy so transferred shall be paid over by the Department to the National Electrification Fund.

    (2) The manner of utilising the levy shall be as in the Order (Cap. 54:01 (Sub. Leg.)) establishing the National Electrification Fund.

6.    Application of Regulations

    These Regulations shall not apply to?

    (a)    electricity sold for purposes of bulk supply in accordance with the Electricity Supply Act (Cap. 73:01);

    (b)    electricity exported in accordance with the Electricity Supply Act (Cap. 73:01); and

    (c)    electricity that is not supplied through electricity facilities owned by the Government of Botswana or by the Botswana Power Corporation.

    (b)    imports tobacco or tobacco products, shall pay a levy at a rate of 30 per cent on the value.

4.    Calculation of value of levy

    The value for the purpose of assessing the levy on tobacco and tobacco products?

    (a)    manufactured in Botswana, shall be the cost of production of the tobacco and tobacco products when sold for home consumption in the ordinary course of trade in the usual trade packaging to any buyers not considered to be related to the seller, inclusive of any duty payable in terms of the Customs and Excise Duty Act (Cap. 50:01) and the> >Value Added Tax Act (Cap. 50:03) liable on goods; and

    (b)    imported, shall be the value for customs duty purposes in terms of section 75 of the Customs and Excise Duty Act plus the customs duty paid or payable on the goods transport and insurance costs, exclusive of > >Value Added Tax Act liable on the goods.

5.    Fund into which levy is payable

    (1) The levy under regulation 3 shall be collected by the Botswana Unified Revenue Service established under section 3 of the Botswana Unified Revenue Service Act (Cap. 53:03>) and paid into the Levy on Tobacco and Tobacco Products Fund.>

    (1) A person shall not import salt unless it is in minimum package of 100 kg.

    (2) Subregulation (1) shall not apply to?

    (a)    quantities of not more than 1kg of table or coarse salt imported for household consumption; and

    (b)    speciality salt.

    (3) For purposes of these Regulations, “salt” means pre-packed salt whether table salt or denatured salt and pure sodium chloride, whether or not in aqueous solution (sea water).

1.    Citation

    These Regulations may be cited as the Control of Goods (Restriction on Exportation of Ferrous and Non-ferrous Metal Scrap and Waste) Regulations.

2.    Interpretation

    In these Regulations, unless the context otherwise requires?

    “authorised officer” means an officer in the Ministry of Trade and Industry who is charged with the responsibility of issuing export permits under these Regulations;

    “BURS” means the Botswana Unified Revenue Service established under section 3 of the Botswana Unified Revenue Service Act (Cap. 53:03); and

    “Director” means the Director for the Department of Industrial Affairs.

3.    Registration of scrap metal dealers

    (1) A person shall not export scrap metal and waste unless the person is registered with the Ministry.

    (2) An application for registration under subregulation (1) shall be made to the Director in such form as may be determined by the Minister and shall be accompanied by?

    (a)    a licence to collect scrap metals issued under section 16 of the Waste Management Act (Cap. 65:06); and

    (b)    a BURS Tax Clearance Certificate.

4.    Export permit for export of scrap metal and waste

    (1) A person shall not export any ferrous or non-ferrous scrap metal and waste set out in the Schedule except under an export permit issued in terms of these Regulations.

    (2) Notwithstanding the provisions of subregulation (1), domestic foundries, recyclers, mills and smelters of scrap metal may purchase the quantity of scrap metal at a price predetermined by a formula agreed to between the scrap dealer and domestic scrap metal processing industry.

    (3) The predetermined price in subregulation (2) shall be?

    (a)    Southern African Customs Union price range plus 2 per cent for ferrous metals; and

    (b)    Southern African Customs Union price less 5 per cent for non-ferrous metals.

5.    Application for export permit

    (1) A person registered under regulation 3 may apply for an export permit in writing to an authorised officer.

    (2) An application under subregulation (1) shall contain such information and be accompanied by such documents as may be required by an authorised officer.

6.    Consultation with domestic scrap metal processing industry

    (1) An authorised officer shall, in considering an application for an export permit, ensure that local foundries, mills and smelters of scrap metal are given preference to purchase ferrous and non-ferrous scrap metal and waste from the applicant.

    (3) Where domestic foundries, recyclers, mills and smelters of scrap metal purchase part of the consignment of the scrap metals, an application for export permit shall be considered based on the remaining scrap metal.

7.    Scrap metal destined for export not to be packed

    A person desirous of exporting scrap metal shall not pack such scrap metal into containers prior to receipt of an export permit for ease of verification, inspection or quality assessment by an authorised officer.

8.    Issue of permit

    (1) Where an authorised officer is satisfied that an applicant for an export permit has complied with all conditions as may be required under regulation 5 for the issue of an export permit, the authorised officer may issue the applicant with an export permit.

    (2) An export permit issued under these Regulations shall only apply to a consignment specified in the export permit.

9.    Appeal

    Any person who is aggrieved by the refusal of the authorised officer to issue him with an export permit under these Regulations may appeal, in writing, to the Minister within 30 days of notification of authorised officer’s decision.

9A.    Penalties

    Any person who exports ferrous and non-ferrous metal scrap and waste in contravention of regulation 4 commits an offence and is liable to the penalty prescribed in section 5 of the Act.

    These Regulations may be cited as the Control of Goods, Prices and Other Charges (Restriction on the Importation of Baked Goods) Regulations.

2.    Interpretation

    In these Regulations, unless the context otherwise requires?

“baked goods” means all types of bread, pies, pastries, rolls, cookies, muffins, scones, cakes, cupcakes and other such baked products usually prepared from flour or meal derived from some form of grain; and

    “Director” means the Director of the Department of International Trade.

3.    Restrictions on importation of baked goods

    (1) No person shall import baked goods except with a permit issued under these Regulations.

    (2) Notwithstanding the provisions of subregulation (1), an import permit shall not be required for the importation, by any person, of an amount not exceeding 2 kg of baked goods per week.

4.    Application for import permit

    (1) A person may apply for an import permit in respect of baked goods, on the grounds that there is a shortage of baked goods in Botswana.

    (2) An application for a permit to import baked goods shall be made to the Director, in Form A set out in the First Schedule, and shall be supported by a valid trading licence and accompanied by an application fee of P100.

5.    Issue of import permit

    Where the Director is satisfied that there is a shortage of baked goods in Botswana, the Director shall, within 21 days of receiving an application, issue to the applicant, an import permit in Form B set out in the Second Schedule to the applicant, subject to such conditions as the Director may consider necessary.

6.    Period of validity of permit

    An import permit shall be valid for such period as may be specified in the permit, which period shall not exceed six months.

7.    Refusal to grant permit

    Where an application for a permit is refused, the Director shall notify the applicant, in writing, stating the reasons for refusing the application.

8.    Appeal against refusal to issue permit

    A person aggrieved by the refusal to issue an import permit under regulation 7 may appeal to the Minister within 30 days of receiving the Director s decision.

9.    Penalties

    Any person who?

    (a)    contravenes any provision of these Regulations or a condition contained in a permit issued to him or her; or

    (b)    provides information that is false or misleading in a material particular in his or her application,

shall be liable?

        (i)    for a first offence, to a fine not exceeding P200 or to imprisonment for a term not exceeding six months, or to both, and

        (ii)    for a second or subsequent offence, to a fine not exceeding P400 or to imprisonment for a term not exceeding one year, or to both.

10.    Revocation of S.I. No. 52 of 2003

    The Control of Goods, Price and Other Charges (Restriction on the Importation of Bread Loaves and Pie Pastries) Regulations are hereby revoked.

11.    Transitional and savings provisions

    Notwithstanding the revocation effected under regulation 10, any permit issued or applications commenced under the revoked Regulations, shall continue to be valid as though granted in terms of these Regulations.

1.    Citation

    These Regulations may be cited as the Control of Goods, Prices and Other Charges (Sugar Sweetened Beverages) (Levy) Regulations.

2.    Interpretation

    In these Regulations, unless the context otherwise provides?

    “accountable person” means an importer, manufacturer or producer of sugar sweetened beverages;

    “sugar sweetened beverages” means?

    (a)    waters, including mineral waters and aerated waters, containing added sugar or other sweetening matter, or flavoured;

    (b)    non-alcoholic beverages; and

    (c)    fruit or vegetable juices,

set out in the Customs Tariff Schedule under the Customs Act.

3.    Application

    These Regulations shall apply to?

    (a)    sugar sweetened beverages produced in Botswana; and

    (b)    sugar sweetened beverages imported into Botswana under the Customs Act.

4.    Levy on sugar sweetened beverages

    An accountable person who?

    (a)    imports sugar sweetened beverages that exceeds 4 grams of sugar content per 100ml shall pay a levy at the rate of?

        (i)    P0.02 per gram of sugar content,

        (ii)    P0.02 per gram of sugar content deemed as 25 gram sugar content per 100ml, for beverages imported into Botswana which are not labelled; or

    (b)    produces sugar sweetened beverages that exceeds 4 grams of sugar content per 100ml shall pay a levy at the rate of?

        (i)    P0.02 per gram of sugar content, or

        (ii)    P0.02 per gram of sugar content deemed as 25 gram sugar content per 100ml, for beverages produced in Botswana that are not labelled.

5.    Calculation of value of levy

    The calculation of the value of the levy for the purposes of assessing the levy on sugar content of sugar sweetened beverages under regulation 4, shall be?

    (a)    the total sugar content of the sugar sweetened beverages produced in Botswana; or

    (b)    the total sugar content of the sugar sweetened beverages imported in terms of the Customs Act.

6.    Fund into which levy is payable

    The levy under regulation 4 shall be collected by the Botswana Unified Revenue Service, and paid into the Consolidated Fund.

2.    Interpretation

    In these Regulations, unless the context otherwise requires?

    “Director” means an officer in the Department of International Trade who is charged with the responsibility of issuing import permits under these Regulations.

3.    Restrictions on importation of bottled water

    No person shall import bottled water unless the water is in bottle of more than 10 litres measurement.

4.    Application for import permit

    Notwithstanding the provisions of regulation 3, any person who wishes to import bottled water in bottles of 10 litres or less shall make an application to the Director in Form A set out in the Schedule:

    Provided that an import permit shall not be required for the importation by any person, of an amount not exceeding two litres of water.

5.    Issuance of import permit

    Where the Director is satisfied that the application for a permit under these Regulations has satisfied the necessary conditions, the Director may issue an import permit in Form B set out in the Schedule.

6.    Validity of import permit

    The permit issued under regulation 5 shall be valid for the single transaction or importation that the permit relates to.

7.    Offences and penalties

    Any person who imports bottled water in contravention of regulation 3 or 4 commits an offence and is liable to a penalty specified under section 5 of the Act.

8.    Revocation of S.I. No. 44 of 2018

    The Control of Goods, Prices and Other Charges (Restrictions on Importation of Bottled Natural and Mineral Water) Regulations, 2018 are hereby revoked.

1.    Citation

2.    Interpretation

    In these Regulations, unless the context otherwise requires?

    “accountable person” means a person liable to pay a plastic carrier bag or a flat bag levy under regulation 4;

    “levy” means a charge imposed on a plastic carrier bag or a flat bag under regulation 4;

    “flat bag” means a flat bag under tariff heading 3923.21.07, 3923.29.40 and 3923.29.50 of the Customs Tariff Schedule under the Customs Act (Act No. 33 of 2018) and under the Standards (Import Inspection) Regulations (Cap. 43:07 (Sub. Leg.)); and

    “plastic carrier bag” means a plastic carrier bag under tariff heading 3923.21.17, 3923.29.40 and 3923.29.50 of the Customs Tariff Schedule under the Customs Act and under the Standards (Import Inspection) Regulations.

3.    Application

    These Regulations shall apply to?

    (a)    plastic carrier bags or flat bags imported into Botswana; and

    (b)    plastic carrier bags or flat bags produced in Botswana.

4.    Levy on plastic carrier bags and flat bags

    An accountable person who?

    (a)    imports plastic carrier bags or flat bags shall pay a levy at the rate of P0.15 per plastic carrier bag or flat bag; or

    (b)    produces plastic carrier bags or flat bags shall pay a levy at the rate of P0.15 per plastic carrier bag or flat bag when sold for home consumption.

5.    Calculation of value of levy

    The value for the purposes of assessing the levy on a plastic carrier bag or flat bag under regulation 4, shall be?

    (a)    the number of plastic carrier bags or flat bags imported into Botswana; or

    (b)    the number of plastic carrier bags or flat bags produced in Botswana.

6.    Fund into which levy is payable

    The levy paid in terms of regulation 4 shall be collected by the Botswana Unified Revenue Service and paid into the National Environmental Fund.

2.    Interpretation

    In these Regulations, unless the context otherwise requires?

    “authorised officer” means any person authorised by the Director to exercise his or her powers;

    “Director” means the Director of the Department of International Trade; and

    “maize extruded snacks” means a product that is manufactured using an extrusion based process to develop the final product, usually prepared from corn or maize, this includes amongst others?

        (i)    puffed maize chips, or

        (ii)    puffed popcorn.

3.    Restriction on importation of maize extruded snacks

    A person shall not import maize extruded snacks except with a permit issued under these Regulations.

4.    Application for import permit

    An application for a permit to import maize extruded snacks shall be made to the Director, in Form A set out in the Schedule, and shall be supported by a valid trading licence and accompanied by an application fee of P100.

5.    Issue of import permit

    Where the Director or an authorised officer, upon receiving an application, is satisfied that the applicant has bought at least 40 per cent local maize extruded snacks and wishes to import the remaining percentage, the Director or the authorised officer may issue such applicant with a permit in Form B set out in the Schedule.

6.    Validity

    An import permit shall be valid for single use only.

7.    Refusal to issue import permit

    Where an application for an import permit is refused, the Director shall notify the applicant, in writing, stating the reasons for refusing to issue the import permit.

8.    Appeal against refusal to issue import permit

    A person aggrieved by the refusal to issue an import permit under regulation 7 may appeal to the Minister within 30 days of receiving the Director?s decision.

9.    Penalties

    A person who?

    (a)    contravenes any provision of these Regulations; or

    (b)    provides information that is false or misleading in a material particular in his or her application,

commits an offence and shall be liable to the penalties specified in section 5 of the Act.

    “school uniform” means school tunic, dress, pinafore, shirt, skirt, pants, slacks, blouse, t-shirt, tie, scarf, hat, jersey, tracksuit for a public or private pre-school, primary, and secondary school; and

    “Director” means the Director of the Department of International Trade.

3.    Restriction on importation of school uniform

    No person shall import school uniform except with a permit issued under these Regulations.

4.    Application for import permit

    An application for a permit to import school uniform shall be made to the Director, in Form A set out in the First Schedule and accompanied by a valid trading licence and an application fee of P100.

5.    Issue of import permit

    Where the Director approves an application for a permit to import school uniform, the Director shall, within 21 days of receiving the application, issue to the applicant, an import permit in Form B set out in the Second Schedule, subject to such conditions as the Director may consider necessary.

6.    Period of validity of permit

    An import permit shall be valid for such period as may be specified in the permit.

7.    Refusal to grant permit

    Where an application for a permit is refused, the Director shall notify the applicant, in writing, stating the reasons for refusing the application.

1.    Citation

    These Regulations may be cited as the Control of Goods, Prices and Other Charges (Restriction on Importation of Wheat Flour) Regulations.

2.    Person authorised to issue permits

    For the purposes of these Regulations, “authorised officer” means the officer in the Ministry responsible for trade who is charged with the responsibility of issuing permits for the importation of wheat flour into Botswana.

3.    Restriction on importation of wheat flour

    (1) No person shall import wheat flour except under and in accordance with a written permit issued under these Regulations.

    (2) Notwithstanding the provisions of subregulation (1), an import permit shall not be required from any person who imports wheat flour of an amount not exceeding 12.5 kg, for his personal consumption.

4.    Application for import permit

    An application for a permit to import wheat flour shall be made to the authorised officer, and such application shall contain such information, and shall be accompanied by such documents, as may be specified by the authorised officer.

5.    Issue of import permits

    Where the authorised officer is satisfied that an applicant for a permit under regulation 4 is a fit and proper person and that such person has complied with all the conditions specified for the issue of a permit he may authorise such person to import wheat flour on such conditions as may be specified in the permit.

6.    Appeal against refusal to issue import permit

    Any person aggrieved by the refusal of the authorised officer to issue him with an import permit under these Regulations may appeal to the Permanent Secretary of the Ministry whose decision thereon shall be final.

7.    Penalties

    Any person who imports any wheat flour into Botswana without an import permit or contravenes any provision contained in the permit issued to him shall be guilty of an offence and on conviction thereof shall be liable to penalties prescribed in section 5 of the Act.

8.    Revocation of S.I. No. 40 of 1985

    The Control of Goods (Restriction on Importation of Wheat Flour) (Amendment) Regulations, 2021 are hereby revoked.
