These Regulations may be cited as the Botswana Emblems Regulations.
In these Regulations, unless the context otherwise requires—
“Coat of Arms” includes any portion thereof or any device so closely resembling the Coat of Arms that it may be mistaken therefor;
“National Flag” includes any portion thereof or any device so closely resembling the National Flag that it may be mistaken therefor;
“Presidential motor vehicle pennant” means a motor vehicle pennant bearing the Coat of Arms;
“motor vehicle pennant” means a motor vehicle pennant bearing the National Flag.
(1) No person shall display or use the Coat of Arms for any purpose without the permission in writing of the President and in accordance with the terms and conditions of such permission.
(2) Permission given under subregulation (1) to any person to sell anything bearing the Coat of Arms shall be deemed to authorise the purchaser thereof to use such thing for the purpose for which it was sold.
4. Presidential motor vehicle pennant
No person other than the President may fly a Presidential motor vehicle pennant without the permission in writing of the President and in accordance with the terms and conditions of such permission.
(1) No person other than the President, Ministers, Assistant Ministers, heads of delegations to international organisations and gatherings and heads of external diplomatic missions and the Chief Justice shall fly a motor vehicle pennant without the permission in writing of the President and in accordance with the terms and conditions of such permission.
(2) A motor vehicle pennant shall be 150 mm in width at its widest part, and 230 mm in length.
(3) A motor vehicle pennant shall be flown from the left front mudguard of the vehicle on which it is displayed.
(1) No person shall display or use the Presidential Standard except in circumstances set out in subregulation (2).
(2) The Presidential Standard shall be flown daily at State House during the residence thereat of the President and in every place where the President is making an official visit, for the duration of such visit.
(3) References to the President in subregulation (2) shall be construed as references to the Vice-President or a Minister when the President is absent from Botswana or unable to perform his functions and the Vice-President or a Minister is authorised to perform his functions.
Any person who contravenes any provisions of these Regulations shall be guilty of an offence and liable to a fine not exceeding P50.
