An Act to prescribe the salary and allowances to be paid to the Chairperson and Members of the Ntlo ya Dikgosi.

This Act may be cited as the Ntlo ya Dikgosi (Salaries and Allowances) Act.
In this Act, unless the context otherwise requires-
“Chairperson” means the Chairperson of the Ntlo ya Dikgosi;
“Member” means any Member of the Ntlo ya Dikgosi.
“Ntlo ya Dikgosi” means that Ntlo ya Dikgosi established by section 77(1) of the constitution.

3. Responsibility allowance for Chairperson and Vice-Chairperson
The Chairperson and Vice-Chairperson shall be paid from moneys appropriated for such purpose a responsibility allowance at the rate of P60,851.97 and P52,610.14 respectively per annum.

(1) Every Member who has taken his or her seat in the Ntlo ya Dikgosi shall be paid from the moneys appropriated by law for such purpose, a responsibility allowance at the rate of P43,989.29 per annum.

(2) If a Member is absent from any sitting of the Ntlo ya Dikgosi such salary shall not be paid in respect of the period commencing on the day of such absence and termination immediately before the day on which he or she next attends a sitting of the Ntlo ya Dikgosi.
(3) For the purposes of the preceding subsection a Member who is absent from any sitting of the Ntlo ya Dikgosi with the leave of the Chairperson shall be deemed to attend such sittings.
5. Allowances of Chairperson and Members
The Chairperson and Members shall be paid from moneys appropriated by law for such purpose the allowances prescribed in the Schedule.
6. Allowances exempt from income tax
The allowances payable in terms of this Act shall be exempt from income tax.

1. Subsistence allowance
The Chairperson and any Member shall receive an allowance at the rate of P339.89 for every day or part thereof exceeding four hours that he or she is necessarily absent from home in attending any meeting of the Ntlo ya Dikgosi or any committee thereof.
2. Transport
(1) The Chairperson and any Member shall receive an allowance calculated in accordance with the provisions of subparagraph (2) in respect of one return journey undertaken by him or her by the shortest route in his or her own motor vehicle or by any public road, rail or air service-
(a) from his or her home to any meeting of the Ntlo ya Dikgosi, or of any committee thereof of which he or she is a member, held while the Ntlo ya Dikgosi is not sitting; and
(b) from any such meeting to his or her home during any adjournment of such meeting of three clear days or longer.
(2) Such allowance shall be-
(a) where the journey or part thereof is performed in the Member’s own motor vehicle, at the rate for the time being applicable to public officers;
(b) where the journey or part thereof is performed by any public road, rail or air service, a sum equal to the fare actually paid up to a maximum of the ordinary first class fare payable on such service.
3. Acting allowance
Every Member shall be paid the same amount that would have been paid to the substantive Chairperson, as acting allowance for every sitting of Ntlo Ya Dikgosi during the whole of which he or she presides in place of the Chairperson.
4. Termination allowance
(1) Subject to the provisions of subparagraph (2), a Member, other than one who is in receipt of other emoluments from public funds exceeding in amount the responsibility allowance payable to him or her under this Act, shall on ceasing to be a Member, receive a termination allowance at the rate of 20 per cent of the aggregate basic responsibility allowance drawn by him or her while he or she was a Member.
(2) There shall be deducted from the terminal allowance payable to a Member any sums due to Government.
5. Hospitality and subsistence allowance when abroad
Every Member shall receive a hospitality allowance at the rate of P284.29 together with a subsistence allowance at the rate payable to public officers, for every day or part thereof that he or she is necessarily absent from Botswana attending a conference, seminar or similar function approved by the President.
6. Hospitality allowance
(1) The Chairperson shall receive a hospitality allowance of P8149.70 per annum.
(2) The Vice-Chairperson shall receive a hospitality allowance of P4977.33 per annum.
(3) The Members shall receive a hospitality allowance of P2335.03 per annum.
(4) The allowances paid under this paragraph shall be in addition to any hospitality allowances to which the Chairperson or Members may be entitled by virtue of paragraph 5.
7. Accommodation allowance
A Member shall receive an accommodation allowance at the rate of—
(a) P135,000.00 per annum for the Chairperson;
(b) P64,800.00 per annum for the Vice-Chairperson; and
(c) P64,800.00 per annum for any other member.
